Unemployment Appeal Brief Advice Clinic - Minnesota State Law Library

Brief advice clinic for people who are representing themselves in an appeal of the denial of their unemployment benefits. Individuals should attend the clinic before they file an appeal with the Minnesota Court of Appeals. This is an initiative of the Law Library and the Labor and Employment Section of the Minnesota State Bar Association. Two types of clinics are available: - Telephone clinic: A 30-minute consultation with an attorney over the phone. An attorney will call the clinic customer at a set time. - In-person clinic: Held at the Minnesota State Law Library. Persons attending the in-person clinic will meet with an attorney for 30 minutes to discuss the merits of their case. Then, they will meet with a law student or librarian for 15 minutes to review the appeal forms. - NOTE: This is a brief advice clinic for people who representing themselves. The clinic attorney is not obligated to represent the customer. Before filing an appeal with the Minnesota Court of Appeals, persons can attend the clinic and get advice about how to proceed.

Application process

Call for an appointment to either clinic. Note that making an appointment for the clinic does not extend the time for the appeal. Appointments and clinics may be cancelled at any time due to attorney unavailability.

Required documents

- All documents pertaining to the legal issues including any paperwork received concerning the case; and the names, phone numbers and addresses of all persons involve - The clinic attorney will need to review the initial decision and order denying reconsideration from the Unemployment Law Judge. Details on how to provide this will be given at the appointment. - Preparing and bringing a written summary of the legal situation will also make the most of the time available with the attorney

Eligibility

Residents of Minnesota who have been denied unemployment benefits and have exhausted their appeal options with the Department of Employment and Economic Development - DEED (those who have had a hearing with the Unemployment Law Judge and have also requested a reconsideration and it has been denied).
